The operator is MW Services Limited, company number 120828, registered at 5-9 Main Street, Gibraltar GX11 1AA. A social casino isn’t licensed the way a real casino is. There’s no gaming commission, no licence number to check, and no regulator to complain to. What you get instead is company law, and here the company law is Gibraltar’s.

The Gibraltar problem

This is the clause that made me sit up. MetaWin.us is a product sold to Americans, in dollars, advertised in American English. Its terms say the agreement is “governed by the laws of Gibraltar”, that “the Games are deemed operated from Gibraltar, and your Participation occurs there”, and that any dispute not going to arbitration “shall be brought exclusively in the courts of Gibraltar”.

Read that again if you skimmed it. A player in Ohio with a grievance is contractually agreeing that they were legally standing in Gibraltar at the time, and that they’ll fly there to argue about it. In practice you’ll never get that far, because clause 17 sends almost everything to binding individual arbitration under American Arbitration Association rules, seated in New York, with a waiver of any class or group action.

You can opt out of the arbitration clause. You have 30 days from first accepting the terms, and you do it by emailing support with the subject line “ARBITRATION OPT OUT” and your full name. Opting out costs you nothing and preserves your right to sue. Almost nobody does it because almost nobody reads clause 17.

The terms that will cost you money

None of those are unique to MetaWin. Coin expiry and inactivity forfeiture show up across the sweeps sector, and every one of these sites has an arbitration clause. What earns the low score is the stack: Gibraltar law, no published state list, an aggressive expiry rule, and a liability cap that in most cases resolves to nothing at all.

The document you can’t easily find

Here’s a smaller thing that bothers me more than it probably should. The terms and conditions govern Gold Coins in detail across nineteen clauses. But Sweepstakes Coins, the ones that actually turn into money, are handed off elsewhere. Clause 1 says “SC games participation is governed by the SC game rules.” Clause 6.3 says “Expiry and forfeiture of SC are governed by the SC Game Rules.” The AMOE instructions live in Section 5 of that same document.

So the rules that decide whether your prize coins expire, and how you claim free ones, sit in a separate document. And the legal menu in the site footer carries three links: Privacy Policy, T&Cs, and Responsible Social Gaming. The SC Game Rules aren’t among them.

They exist, and a logged-in player can get to them. But a prospective player standing outside trying to work out whether their winnings can expire is being asked to sign up first and read the important part later.
